These Terms of Use (the "Terms") govern your use of cavalierdg.com (the "Site") operated by Cavalier Design Group ("we," "us," or "our"). By accessing or using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

Eligibility

You must be at least 18 years old (or the age of majority where you live) to use the Site or, if younger, use it only with a parent or guardian who agrees to these Terms on your behalf.

Use of the Site

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for its intended purpose. You agree not to: (a) use the Site in any way that violates applicable law; (b) copy, scrape, or harvest content or data except as permitted by the Site's robots directives; (c) interfere with the Site's operation or security, or attempt to gain unauthorized access; (d) upload malicious code; (e) misrepresent your identity or affiliation; or (f) use the Site to send unsolicited communications.

Intellectual property

The Site and its content (text, graphics, logos, photographs, video, design, and software) are owned by Cavalier Design Group or its licensors and are protected by copyright, trademark, and other laws. Except for the limited license above, no right or license is granted. Our names and logos may not be used without prior written permission.

Testimonials and results

Testimonials on the Site reflect the real experiences of individual clients or customers. Results vary and depend on individual circumstances; they are not a guarantee of your results. We do not pay for reviews; where a reviewer received anything of value we say so.

The Site may contain links to third-party websites or embed third-party services. We do not control and are not responsible for their content, policies, or practices; your use of them is at your own risk and subject to their terms.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CAVALIER DESIGN GROUP AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE, AND OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US THROUGH THE SITE IN THE 12 MONTHS BEFORE THE CLAIM OR $100. These limits do not apply to liability that cannot be limited by law.

Indemnification

You agree to defend, indemnify, and hold harmless Cavalier Design Group from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, or your misuse of the Site.

Governing law and disputes

These Terms are governed by the laws of the State of Florida without regard to conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to their jurisdiction, except that we may seek injunctive relief in any court of competent jurisdiction.

Changes and termination

We may modify these Terms at any time by posting the revised version with a new effective date; material changes will be highlighted on the Site. Your continued use after the effective date constitutes acceptance. We may suspend or terminate access to the Site at any time for any reason.

General

These Terms, together with the Privacy Policy and any policies linked from the Site, are the entire agreement between you and us about the Site. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor.
